This is a common question for those who are facing a divorce–should I go Pro Se or do I need to hire an attorney? It’s hard to understand whether it’s worth dropping a boat-load of cash in order to succeed in getting what you want, or by going it alone and risk losing everything. Unfortunately, confidence and faith in yourself are two big key factors when it comes to Pro Se litigation.
Money is tight already as it is when you’re going through a divorce–sometimes you will have temporary orders set up for you to pay a certain amount in child support or help pay the mortgage on the house while you shack up at a hotel room for a few weeks. Not having a good division of whose money is whose can also make finances a bear to handle. This, in turn, leaves very little for an attorney, and leaves many facing the question of hiring a lawyer or self-representing themselves in the courtroom.
If you represent yourself, you are truly your own expert. You know the history of the marriage, you know the specific financial situations that can arise, you know your ex-wife and what she’ll want out of you in the court process, and this in itself is invaluable information that no attorney will ever truly grasp. By going Pro Se, your knowledge of the marriage will assist you in making the right decision for you, your children, and your financial future.
Not everyone is well-versed in the legal field, however, and it can be a little intimidating, so if you have a little bit of money to spend on pursuing your divorce in court, consider hiring an attorney as a co-counsel, someone to give you advice through the trials, or a legal coach that can help you with a little bit of the extra leg-work throughout your case. This way, you’re still going it alone, but you’re paying out a lot less for a little bit of friendly advice along the way.
It’s entirely your decision, but as long as you have the confidence in yourself and an open mind to learn the court system, you will do just find as a self-represented father in court.
